SDSU alleged rapists - civil suit has been filed

Recommended Posts

From the LA Times-

A civil lawsuit filed Thursday in state court accuses three San Diego State University football players — including a top punter now in the NFL — of gang raping a 17-year-old girl last year at an off-campus party....

https://www.latimes.com/california/story/2022-08-25/nfl-matt-araiza-sdsu-football-players-accused-rape-lawsuit      Sorry, it's a paywall. Matt Araiza is formally named.

The other men named in the complaint are Zavier Leonard and Nowlin “Pa’a” Ewaliko. Leonard is listed on the university’s fall football roster as a redshirt freshman. Ewaliko was on the team last year as a freshman but is not on the current roster.

As far as Araiza...wasn't there some tweets that named him WAY before the accusations reached the media? That seems to go against the fact that they are just going after him since he's in the NFL and they can get money from him.

Edit: Araiza is +++++ed.

Quote

At the request of police, she made pretext calls — recorded by detectives — with the men named in the lawsuit whom police “had determined were present in the room when the rape occurred.” Araiza, the complaint alleged, confirmed on a call in late October that they had sex and recommended she get tested for a sexually transmitted disease. Later in the conversation, she asked him, “And did we have actual sex?” Araiza allegedly changed his tone and replied, “This is Matt Araiza. I don’t remember anything that happened that night.”

Or was ++++ed? Seems he may have had consensual sex with the girl and then led her into the house where he or some teammate allegedly gave her a drink and then someone led her into the bedroom where the alleged rape occurred.

Yes she was just 17 at the time but did he know that? (When our son was 20, he had been having sex with a 17-year-old and although nobody went to the law about it, the mother of one of his friends contacted the girl's mother and encouraged her to file a report of statutory rape. Thankfully, although we hadn't met the mother, she invited us to her house to talk about it and said that although her daughter told her our son was 18, she never heard that from him and thought he was a nice young man or some such thing so had no intention of involving law enforcement. I can tell you from that event that in California, the greater difference in age between the young man and the still not adult girl, the more chance the DA will press statutory rape charges and if the adult is convicted, he can be sentenced to having to register as a sex offender for the rest of his life. Also, fwiw we found out the age of consent in Nevada is now 16 which IMO is much more logical in this day and age.)

All that said, even if Araiza thought the girl was 18 or older, if he facilitated a rape by two teammates, he deserves to serve some jail time.

He knew she was in high school, that should have been enough to know that she was almost assuredly underage:

Quote

According to the lawsuit, the teen told Araiza she was a high school student and, even though he could see she was highly intoxicated, he told her to perform oral sex, then had sex with her. Then Araiza took her to a bedroom where Leonard, Ewaliko and at least one other man were, the complaint alleged, and threw her down on the bed face first. The lawsuit said she was raped for an hour and a half until the party was shut down.

There have been no charges filed to date. Lawyers can and will say anything to advance their clients case. Wait until the legal system has had its say before tarring these young men.

We KNOW FOR A FACT that Araiza was aware she was still in HS? How do we know that? Did Araiza admit as much? I think SDSUFan is correct that maybe we should all just wait and see how this plays out before jumping to conclusions.

Why are you so insistent on defending Araiza? Let's assume that he didn't know for sure. She was still drunk, which equals no consent and she had physical trauma too. There's a lot of ways in which he and the others +++++ed up.

Let's see what the DA does now that the PD has referred the case.

He was victim blaming in the main thread.

Is this too hard of a question to answer?

As a dad I've unfortunately been on both sides of this issue, and have some pretty good knowledge of a few others.  I'm a very firm advocate of letting the process play itself out, and then hammering the guilty party.  It's never as cut and dry as it looks up front, but in the end if there is a guilty party they need to feel the pain they imposed on their victim.
