Because giving them back is an admission you took them in the first place, even on the off chance that it was inadverent. (Oops...I accidently took 11 boxes of classfied documents...)  When has Trump ever admitted to ANYTHING?

Still though, there is absolutely no reasonable reason for Trump have possession of these. Only bad things could come from it. 

This has been mentioned............trump is great at playing dumb & this could come down to him saying he didn't know about any "laws" 

Plus he's always one or two people removed from the actual "hands on" activity

The other aspect of this is that all trump has to say is that some staff grabbed the boxes and trump had no idea what were in the boxes...............remember back when trump exited the White House, there where photos of various people hauling boxes out.

Pinning this on trump directly will be difficult unless there's some absolute proof of trump involved in trying to peddle the information to foreign entities

When Trump couldn't get the courts to overturn his election loss in 2020 and then couldn't get state electors to do so and then couldn't get Mike Pence to commit to doing so, he turned to encouraging violence by his supporters.

Many knew he would eventually face his comeuppance through the legal system and that's now coming to pass. So make no mistake. That POS is going to do his best to foment another civil war. (But he will again fail and at that point will likely become so unhinged that he'll fly to somewhere like Hungary to escape from justice.)
