Well, it is silly that a "special master" will be required for the government to read its own documents.  The fact of the matter is the actual CONTENT of the documents is of little importance at this stage.  The facts are Trump HAD the documents, was asked nicely to return the documents, received a subpoena for the documents, then lied that he turned them over.  

The DOJ isn't going to "unsee" what it has previously already seen and knows are in those files.  On that basis they should just proceed to indict Trump and his two lying attorneys as co-defendants.  The prosecution of the case isn't going to depend on what was in those files in the first place and they won't want to share that classified information anyhow.  

If the DOJ is smart they will indict him the day after the election and not spend time chasing around this rabbit hole of the special master that doesn't matter in the investigation anyway.

I assume they can. It just makes the case much harder to prove if some of these documents cannot be used as evidence because the special master deems them protected under privilege. It could end up meaning the DOJ would not have enough evidence to prove a case?

Remember when trump said on “truth” that Obama had nuclear secrets?  He always telegraphs everything he does by accusing others of the same thing.

If this was Hillary Clinton, the magatards would be demanding her head.  Donald Trump should spend the remainder of his pathetic life in a supermax facility next to the likes of the shoe bomber.  These are docs that can’t be declassified. They are so sensitive they’re kept in secured storage in one of the most secure facilities in the United States.

These people, including myself, were upset that Clinton mishandled classified documents as SoS. But this is next level bullshit.  Put him in a box and throw away the key.

Correct. First, I expect the appeal to be upheld at least in part to the preposterous review for executive privilege.  For attorney-client privilege that would only be a small swath of the documents. It will, however, delay any indictment even though the DOJ could file an indictment now in the D.C. Circuit.

But it shouldn't delay and indictment.  The internal contents of those documents have absolutely no impact on the case and could not be shared anyway.  The fact of the matter is he stole top secret nuclear documents and VOLUMES of classified materials and refused to return it after he was asked nicely AND subpoenaed.  If the DOJ let's this special master thing delay the filing of charges they are idiots.  At least if they indict him the trial judge may rule contrary to the Trump judge.

Even before the #loosecannon ruling for a SM, word had come down any indictment was going to wait for midterms.  This may end up not delaying indictments by much or at all.

It's not a rare thing. Usually applies when there's an especially sensitive case. The important thing to know is that the judge appoints the special master. They work for the judge and the judge alone.
