A 21 year old had sex at a college party. She lied about her age and snuck into said party. It was dumb but not predatory. Unless there’s something malevolent about the girl that engaging in such an act would make him a scumbag, I think prosecutors got it right.

Then again the law is different in Nevada.

ESPN says Araiza has filed a defamation suit against SDSU.  Exactly what did SDSU do to defame him?  Hell, on this board people were livid that he was essentially not being defamed by publicly naming him earlier, until SDPD went public.  I am not near campus so I don't hear any scuttlebutt on this, but that part was a little odd.  The girl's lawyer and maybe the girl should catch a suit.

It is called money lol. SDSU has money this girl most likely does not. Suing her gets him nothing, suing SDSU could get him millions (ie he can say he lost x amount of millions by losing his NFL career or false allegations).

Okay, but what false allegations did SDSU say?  The girl had false allegations, the lawyer made public a bunch of stuff that was framed to defame.  I understand sue where the money is, but just not sure what exactly SDSU did to defame him.

He should sue the attorney for sure, the girl too, but definitely the attorney; file an ethics complaint while he’s at it.

I’m not seeing any case there against SDSU. Was it a talking head on ESPN reporting the suit? I’m not seeing that reported anywhere else.

Hard to tell if he knew or not her age and intoxication level.  Initial reports are that it should have been obvious and people knew she was in high school.  That now seems in question based on witness  accounts.  Could they be lying to protect their buddy?  Sure.  

I feel safer saying the people in that room were scum bags.

I'm not going to share it here, but she is on camera, literally in the same costume, lying about her age. Apparently, it's from a different party earlier in the week but you have to believe the police were well aware of the video(youtube) if the general public found it. That was always going to make it challenging(statutory rape charges in CA) without direct evidence Matt and others knew her age.

If he knew she was in high school, and did not request to see ID, that would indeed make him a piece of shit.  Reports are conflicting on if he knew that or not, though.  So I will say "possible piece of shit".  In most states he would be guilty of statuary rape regardless of what she said.

She said she went to Grossmont. The problem with that is 9 out of 10 people at SDSU know that to be the local JC, not also an HS in the same region...especially not someone who came to State from outside the area.

Seems "if she lied about her age it's not rape" is kind of loophole to...well...statuary rape kids "just tell them you are 18"  "She said she is 18 wink wink".  Seems like bad law.

In pretty much every other state he would be guilty of felony statuary rape....I think the rest of the country has it right and California has it wrong.  "Bro she totally said she is 19 let's gang bang her"

Except for Araiza ,all the involved were deactivated from the Team and went into the Portal. To date, none of the named players has an offer.

Idaho has a 3 year age difference exception for 17 year olds. Nevada’s is 4. California has neither.
