Yeah!  Then when Biden wins, They should first divide California into 6 states and use that newly gained congressional capital to force an appeal of the 23'rd so they can grant DC statehood!

No but they will eliminate the legislative filibuster.

I didn’t say whether I approved it or not.  I just said it will for sure happen and will make for a very uncertain legal environment.   Both sides write laws targeting the other like Trump did with the mortgage tax and sales tax write offs.

The legislative filibuster still lives. It was recently employed to kill a police reform bill and a Covid relief bill. So yeah, I think it’s safe to say the Republicans weren’t going to remove it even if it would get them what they want in the short term.

It look like we have 48 confirmed no votes. 3 more and it’s over. I think McConnell will confirm votes and if they aren’t there he will make a recess and let Trump do a recess appointment. Then who ever wins gets the final appointment.

Historically, In the 1800s, Congress was increasing the size of the Supreme Court to match the increasing number of federal judicial districts being created. There is historical precedent for changing the SCOTUS size along with the more recent tradition of only 9 members.

There are currently 12 federal judicial districts (11 covering the states plus a separate district for DC). A change to 12 associate justices plus a chief justice might be historically supported.

The GOP are, in fact, the ones who most recently utilized the "nuclear option" to remove the filibuster.
