There's a federal law that already says that you can apply for asylum if you enter illegally. Presumably it is because sometimes the country you're leaving will not grant you an exit visa (other countries have those) so you have to leave illegally anyway. In this case however I agree with you. Apparently their assessment of the safest route loomed large.
