Colorado says fishing next to private land is trespassing

If you care about fishing or boating Colorado’s rivers, this ongoing legal case should have relevance for you. Roger Hill is a 76-year-old Coloradan who likes to fish while standing on the bed of a stream. One of his favorite spots is a stretch of the Arkansas River below Salida. 

A local landowner claims that Hill is trespassing when he stands on the streambed adjacent to the landowner’s property. He has responded by repeatedly throwing rocks at Hill while he is fishing and leaving threatening notes on his car. The landowner even shot at one of Hill’s fishing buddies, though he was thrown in jail for that little stunt.

Good grief.  This is my fear for Idaho and why keeping public lands public is the most important voting issue for me. 

So glad Labrador will not be the next governor.

Same in NM. You can't get out of your boat and pee after drinking all that PBR, even midstream. Landowners string up cables and threaten fisherman regularly.

I just think it is funny that conservatives like socialism and having other people pay when it is something they like but don't want to pay for things they don't line.   Kinda like Cliven Bundy.

Varies by state, in wyoming the landowner also owns the stream bed,  you can float it but not anchor, wade or pee on the bank.  Many states say ownership ends at the high water mark.

In Utah I believe that public access to fishermen extends to 20 ft past the high water mark

Heaven forbid anyone makes decisions on merit and not a party line.

All I think. There was quite a battle over it not long ago. The fisherman lobby won out over a few wealthy land owners.

Colorado has a total hard-on for trespassing. I know where it comes from, especially in the hunting areas, but it's still a bit odd.

Navigable streams are supposed to be rivers that flow to oceans and can carry trade.

According to the EPA if you are permitting a mine all streams in Nevada are navigable even if they only flow part of the year.  None in the great basin flow to the ocean.of course.  Not much barge traffic on the Truckee or the Humboldt let alone the 6 inch wide rivulets in march that disappear by may.

 

I don't know about Utah specifically but states all have varying rules about this.  Some have different rules for navigable streams and others even allow a landowner to own the stream.
