Cannon denies Trump's absurd motion to dismiss the documents case based on the PRA.  But, she swerved on Smith's late night filing leaving open Trump's ability to defend at trial the same line of false reasoning or about any line of defense. The 3-page ruling concludes w/:  “The parties remain free to avail itself of whatever appellate options it sees fit to invoke.”

Smith may be filing the mandamus w/the 11th sooner than later?  The issue of jeopardy being attached once this delayed trial actually begins is at issue.

He has to. This ruling is actually a huge win for Trump. If she dismissed charges now it's appealable. It's obvious her intention is to let the trial start and then dismiss the charges so it can't be appealed.

Smith doesn't have file the mandamus yet as this is very unlikely to go to trial anytime soon.  @rgoodlaw gave a good take on Cannon's fvckery on air this eve.  Smith knows what's up. He'll file before the trial strategically.

An appeals court judge has denied former President Donald Trump’s request to delay the start of his New York hush money trial so he can challenge the gag order imposed by Judge Juan Merchan.

New York Associate Justice Cynthia Kern denied the application for an interim stay just minutes after hearing arguments on the matter Tuesday.

A full appeals court panel will still consider Trump’s petition, though it will not delay the start of the trial.

There are multiple Jeremy Rosenbergs in New York City, as former President Donald Trump's attorneys found out Tuesday after they sent a subpoena to the wrong one.

Last month, Trump's attorneys in his criminal hush money case in Manhattan sought to subpoena the Jeremy Rosenberg who was a supervising investigator in the Manhattan district attorney's office.

Instead, according to court filings revealed Tuesday, the subpoena went to another Jeremy Rosenberg living in an $8 million Brooklyn home.

"I don't have any files for you," that Rosenberg wrote to defense attorney Todd Blanche, per the court filings.

Furthermore, that Rosenberg wrote, "I'm keeping the fifteen dollars" Blanche had provided to help him pay the cost of sending the requested documents.

Prosecutors informed the court that was not the Jeremy Rosenberg Trump's legal team was looking for, after Blanche complained Rosenberg was not being cooperative.

"After receiving defendant's pre-motion letter, the People spoke with Mr. Rosenberg's counsel, who informed the People that Mr. Rosenberg was not, in fact, served with the subpoena, that Mr. Rosenberg had not corresponded with defense counsel, and that Mr. Rosenberg does not have any connection to the Brooklyn address where the subpoena purportedly was served," prosecutors said.
