SDSU signed a legal binding contract. They knew exactly what was in the contract before they signed. Playing hardball would be the MWC asking for more than what was in the contract
 

From a business stand point, if SDSU leaves, the MWC loses their best basketball team, a top of the conference football team, Southern California direct recruiting trips. Not to mention,  it destabilizes the conference in other ways like future media contracts. This all has a big, long term price tag attached to it. 
 

Also, this tells current schools and potential schools that they mean business when it comes to this. If they make deals with every school that wants to leave, why sign a school wide contract to begin with? 
 

Once you start making deals, everyone will expect a deal after that. 

You apparently missed the part where the MWC is holding SDSU "hostage".  Clearly that changes things.

At least 2 of the schools in your sentence had to vote yes in 2021. And that is assuming someone like Fresno or Nevada was not a no vote.

Of course none of us really know who voted which way.

For all we know it could have been unanimous yes if no one trusted anyone else being the first to leave. Or could have been a unanimous yes vote because academics often like to look like they are in total agreement after they have discussed something. We don't know.

One poster from UNLV said they did not vote for the fee increase. CSU, AFA and BSU have all been in conversations about leaving for the AAC before they got poached by the P12. I do know, though, that SDSU would have voted for increasing the fee so when people on here said we signed on to this we didn't.

The exit fee going to $37M now? Where are you getting that from? SDSU has already said they won't pay the penalty for leaving late, and they sure as hell are not going to stay in an extra year when the conference will likely increase the fee again come July.

You don't have to worry about paying any fee right now, you don't even have an invite. The Pac probably made you a silent deal as a backfill.

The battle goes back to Steve Fisher’s days as SDSU head coach. He regularly advocated for a 16- or even 14-game schedule, which in his mind provided more opportunities to play quality nonconference opponents in November and December. 

Yeah, we went 16-2 in the conference and didn't get into MM because we didn't win the conference tournament. We were a one bid conference that year. Playing more games in conference wasn't something we wanted to do. That doesn't show disdain for the conference, we were just saying that our conference schedule did not help us build a resume that would get us into MM.

Elon Musk is landing rockets on barges and putting US astronauts back in space on US rockets in a US capsule. Boeing has had just one unmanned launch of its Starliner and they have been in the space industry decades before Musk started SpaceX. Elon is an amazing guy.

FYI - SDSU NEVER signed any legally binding "contract" with respect to the exit fees, nor did any other MWC school.  That was the result of a bylaw amendment enacted unilaterally by the MW board.  I have no clue as to the circumstances, however, IF SDSU voted no on the bylaw amendment AND they can show that they, or another MWC school, were being courted for another conference anywhere near that time, I'd bet that it is likely that the bylaw amendment would be thrown out by a judge and the former exit fee would be enforced.

I've done it twice to public companies on bylaw changes and won both times.  Once on a company incorporated in Delaware and once in Nevada.  IIRC the MW is incorporated in CO.  I've no clue as to CO law but I've heard that it's similar to NV law from a corporate governance standpoint - that's a crapshoot as NV corporate law is a joke and is the reason why fraudsters choose to incorporate in NV (FYI never invest in a co. incorporated in NV).  If it was in Delaware, SDSU would face a much higher probability of success.

Nonetheless, if SDSU voted no on the bylaw amendment and a school in the MW was having discussions with another conference I'd say that, and the early quasi "notice", is enough leverage for SDSU to attempt to get the exit fees capped at 3x the annual distribution and paid out over a few years.

Wicker has said recently on several occasions that SDSU wants to continue to be good partners with MW schools as they separate so from those statements I think SDSU would be fine paying the new exit fee (3x annual distribution) but just over a few years.
