I've no idea what was signed when SDSU came back but it is implied that all members would abide by the bylaws (it is the organization's governing document) so I would doubt that there was a specific clause for that but I don't know for certain - it just seems redundant and unnecessary. Even if SDSU did sign something about abiding by the bylaws, I would be willing to wager it wouldn't have any impact on the matter at hand. If it goes to court, I don't think it will, but if it does, the MW will argue that as a member of the conference SDSU is bound to the bylaws and thus owes the $17mm by next June. SDSU would likely counter with the fact that the bylaws were changed recently, that SDSU did not vote for the amendment (someone told me this but I haven't confirmed), and that the amendment was put in place to make it financially onerous for a member to freely leave thereby impeding a member's right to leave. Further, SDSU will likely claim it was done while SDSU and/or other member schools were involved in talks to leave. It depends upon the judge and the state, but most judges don't view bylaw changes favorably particularly when they disadvantage members/shareholders and are made as a reactionary, defensive measure by the board. But you never know with any certainty how a judge will rule, I've had some who ruled against me where three months earlier under the exact same circumstances they ruled for the plaintiff. I don't think this goes to court. Neither side really wants to, but SDSU is more motivated because it's $17mm for them vs $1.7mm for each remaining voting member so I think it gets negotiated down to something like $8-12mm paid over three years or something like that. It is kind of funny to see posters get all worked up over this. It's just a business disagreement and those happen all of the time.
  2. What’s in it for the conference? Well they could go from a theoretical $34mm or so to a hell of a lot less. What was the former exit fee prior to the bylaw amendment? That’s what SDSU would pay if it goes to court and the bylaw amendment is overturned. Not to mention that in discovery every MW President and AD would have to turn over their emails from their university account plus all of their private accounts as well as texts, slacks, etc. Who wants to sign up for that so that each school has the possibility to potentially make an extra couple million?
  3. As I stated in the other thread the exit fee was not contractual but rather a bylaw change enacted perhaps after rumors began of MW schools leaving. If SDSU voted against it and the rumors have any substance to them it’s likely that the bylaw amendment would be overturned by a judge and SDSU would pay the prior exit fee which I’ve no clue what it was but it was certainly lower and less onerous.
  4. Just a WAG here, but I wonder if SDSU sent this "notice" as a way to hedge in case things go sideways and end up in court. They could try to make an argument that this notice was sufficient, that they attempted to negotiate in good faith, and the MW didn't play ball. Thus they don't owe the 6x annual distributions, just 3x. It could be a point of leverage against the MW because the only money the MW would get would be the witholding of the conference distribution (~$6-7mm), have to wait for the court case to get settled, and pay legal fees along the way. No idea how that would play out in court but could be the reason for the notice this week.
  5. Lemme guess - the “valley” extends past Merced to Modesto, Stockton, Sacramento and to Redding. And because Sacramento is the same distance from Fresno as LA, then we’re including the entirety of LA, San Bernardino, Ventura, SLO, and basically all of CA save for SD county. All the rest are fans of Fresno.
  6. Not trying to jam you up, but rather inform. You’re correct that Phil Knight only owns 2% directly but the other legal entities and family members that are used own the rest. Like I said, I’ve no clue what transpires after he passes so who knows.
  7. Phil Knight still owns 17.2% of Nike (worth $28 billion) through his, his wife's, and his foundation's ownership. Most of it is class A shares which allow holders to elect seven board members. The only people who own class A shares are the Knight family. Everyone else owns class B shares which can only elect three members of the board. His son is on the board and owns another 2.7% (mostly A shares, worth $4 billion). The Knight family controls Nike and will continue to control Nike even after Phil passes. What this means to Oregon, I don't know. But his son graduated from Portland State so who knows.
  8. A point of clarification here. The proposed deal is reportedly between $380mm and $450mm per year inclusive of SDSU and SMU "or another 12th member". The range depends mainly upon how much streaming but there are "other variables in play" (I didn't ask what). So assuming SDSU and SMU get full payouts the range is $31.7mm to $37.5mm. Assuming SDSU and SMU get 50% shares over the life of the deal on average then its between $34.5mm to $40.9mm for existing members and between $17.3-$20.5 on average for SDSU/SMU. That info is over a week old and they are still negotiating some things so it could change but was told the Pac schools feel confident in that range.
  9. I'm hesitant to post this because it's not certainty, but given the outright stupidity that Yoda has already posted and 725 pages of nonsense then what the hell... FWIW these are predictions from two relatives/acquittances who are connected to or are decision-makers - take them for what you want. They aren't 100% probabilities, but better than 50% IMO. Pac12 has a "good deal" that's "mostly done", from what I've heard, at least from a couple of people I know who would know. Granted that's from just two people but I'm pretty sure one knows definitively. The deal is supposed to be in the $38-45mm range ex-additions with the variation depending upon the percentage of streaming content - that's sill TBD. The addition of SDSU brings that figure down a bit and SMU brings it down further from what I'm told. That's from one person who used to work in a P12 AD and still has connections there but I can't corroborate. So I'm not 100% confident in that estimate but I think that range is good for a P10 estimate - but lower for a P11 or a P12. Heard further from source in B1G that B1G highly likely not expanding until ACC breaks. Consensus in B1G is that they are waiting to see a challenge to the ACC GOR or if the conference implodes prior to that due to individual schools challenging GOR. The B1G "has always played the long game" - that's why a bunch of schools in BFE who otherwise no one under 65 gives a crap about are about to control college sports. They want the school that provides the most tv value (duh). Western schools don't provide as much value and are down lower on B1G's list than ACC schools. Little appetite for current P12 schools and would rather not deal with PT schools - "We already have two to deal with, rather not have more". Like I've said before, B1G likes Colorado if they can provide assurances as to athletic dept budget. "I think the conference would be inclined to add a school in the middle of the country in a very large market that was a good cultural fit."
